1. Our Services

We provide physical assessment descriptions based on athletic screening. Our services are intended for performance and safety insights, and they do not constitute a medical diagnosis. Please regard this as our formal medical diagnosis disclaimer.

2. Bookings and Payment

1. All bookings are processed securely via Cal.com.
2. Payments are handled exclusively through HitPay.
3. All fees are listed and charged in Singapore Dollars (SGD).
4. Your booking is confirmed upon receipt of full payment. Late arrival may result in a shortened session.

3. Cancellations and Refunds

1. Cancellations made 48 hours or more in advance are eligible for a full refund (48hr policy).
2. Cancellations made between 24 and 48 hours in advance will incur a 50% fee (24hr policy).
3. Cancellations made less than 24 hours before the appointment are non-refundable.
4. Failure to attend without prior notice (no-show) will result in the forfeiture of the full booking fee.
5. We reserve the right to cancel or reschedule appointments due to unforeseen circumstances.

4. Upgrade Credit Policy

1. Clients who complete a Tier 1 assessment will receive a credit toward further services.
2. This Tier 1 credit can be applied toward Tier 2 or Tier 3 package upgrades.
3. The credit is non-transferable, cannot be exchanged for cash, and must be used within the specified validity period.

5. Health Disclaimer

1. Our assessments and recommendations are not medical advice.
2. You are solely responsible for determining your health suitability prior to the assessment.
3. You must provide a full disclosure of past or current injuries before testing begins.
4. We reserve the right to refuse service if we deem the physical assessment unsafe for you.
5. You agree to participate in the physical assessments at your own risk.

6. Assessment Reports and Data

1. Assessment reports are generated for your personal use only.
2. We make no guarantees regarding race outcomes, injury prevention, or athletic improvement.
3. You take personal responsibility for acting upon any exercise or training recommendations.
4. We may utilize aggregated and anonymised data to improve our services and operations.

7. Intellectual Property

1. All website content, text, and graphics are protected by copyright.
2. Reproduction or distribution of our materials without written consent is strictly prohibited.
3. VALD trademarks, software, and associated intellectual property belong to their respective owners.

8. Limitation of Liability

1. We shall not be liable for any indirect, incidental, or consequential damages arising from our Services.
2. Our total liability cap for any claim is limited to the amount you paid for the specific service.
3. This limitation does not apply to the negligence exception where liability cannot be excluded by law (e.g., personal injury caused by our gross negligence).

9. Third-Party Services

Our Website and Services utilize third-party platforms such as Cal.com for scheduling and HitPay for secure payments, and may contain social media links. We are not responsible for the availability, content, privacy practices, or terms of these third-party platforms.

10. Governing Law

These Terms shall be governed by and construed in accordance with Singapore law. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.

11. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Any changes will be posted on this page, and the latest version will always be available at beforeyourace.com/terms.
